Rules for purchasers using our Premium Membership management service.
The following are the rules, or Terms of Service ("TOS", "Agreement"), that govern your use of the
Crowdstack Pay service, which is managed by Crowdstack, Inc. and its related entities, including Social Strata, Inc. ("Crowdstack", "us", "we").
By using Crowdstack Pay through the purchase of (or complimentary use of) a
premium membership ("PM") from a participating site ("Participating Site"), you ("you")
expressly agree to be bound by the TOS and all applicable laws and regulations governing
your use of Crowdstack Pay. In addition to the fees charged by the Participating Site, any applicable state/local taxes will also be collected at the time of purchase, based on tax laws in place at the time. The TOS can be reviewed online at
https://www.crowdstack.com/policies/pay-terms-for-purchasers.php. We reserve the right to change the TOS at any time, effective upon
posting to that web location. If you violate the this TOS, we may cancel your
premium membership and/or take appropriate legal action against you.
We respect your
privacy and the information that you provide to us is subject to our
Privacy Policy.
Payment Methods
Crowdstack Pay accepts several
methods of payment to accommodate your needs, including Visa-, MasterCard-, American Express- and Discover-branded credit/debit cards. (If you have been given a complimentary premium membership, no payment will be required.)
Control of Memberships and Transactions
The Participating Site controls the rights conveyed with the PM and sets the fee that is
charged to you. Crowdstack Pay handles all transaction processing on behalf of the
Participating Site, but has no affiliation with the Participating Site except as a service
provider. Crowdstack Pay is ONLY responsible for ensuring that your payments are collected in a
secure manner and that your PM is activated and deactivated on the Participating Site, as appropriate. The
Participating Site has no access to credit card information you provide for payment.
You understand that Crowdstack Pay has no control over the management of the Participating Site from which you purchased a
premium membership. Further, you agree to hold us harmless
in the event that the Participating Site fails to honor its agreement to provide you with the premium features your purchased from them.
Renewals/Recurring Billing
Your membership will be renewed automatically when its term expires, assuming the premium
membership price plan is still available and the price has not increased. If the plan
price ever increases, you'll be notified by email, and you'll have to manually renew your
membership at the end of the current term. You will receive an email notification each
time your subscription is renewed. To manage your premium membership, sign in on the Participating Site
and navigate to: Manage > Premium Membership.
Cancellation
You may cancel your account online at the Participating Site. Cancellation will be
effective at the end of the term for which you have already paid. The Participating Site
and/or Crowdstack may also cancel your account at any time.

Refunds
When you initiate a cancellation, all payments are nonrefundable by Crowdstack Pay, without exception,
even if you cancel prior to the end of the current membership period.
If your premium membership is terminated by the Participating Site, you will automatically receive a pro rata refund for the period between the termination date and your prepaid ending date. If we terminate your premium membership, a pro rata refund will be issued at our sole discretion. You may contact us about refund issues via our
support site. The maximum refund you may receive will be based
on the pro rata portion of your paid term for which you did not receive premium
membership benefits.

No Warranty
WE, OUR AFFILIATES,
EMPLOYEES AND OUR SUPPLIERS PROVIDE OUR SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR
CONDITION, EXPRESS, IMPLIED OR STATUTORY. WE, OUR AFFILIATES, EMPLOYEES AND OUR SUPPLIERS
SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE AND NON-INFRINGEMENT.
Limitation Of Liability
IN NO EVENT SHALL WE, OUR EMPLOYEES, AFFILIATES OR SUPPLIERS BE LIABLE FOR
ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS
SERVICE, OUR WEB SITE, OUR SERVICES, OR THIS TOS (HOWEVER ARISING, INCLUDING NEGLIGENCE).
Some states do not allow the exclusion or limitation of incidental or consequential
damages, so the above limitation or exclusion may not apply to you.
Copyright and Proprietary Rights
Our products, web site, and software are All Rights Reserved (c) 2020 Social
Strata, Inc. and are protected by United States and international copyright laws. We reserve all right, title and interest to any products and/or software and all
associated icons and graphics, including but not limited to the Crowdstack(tm),
Crowdstack Pay, and Crowdstack logos and trademarks (collectively, "Crowdstack Marks"). Title
to and ownership of the software and Crowdstack Marks, including without limitation all
intellectual property rights therein and thereto, are and shall remain the exclusive
property of Crowdstack and its suppliers. You recognize and agree that nothing
contained herein shall be construed as granting you any property rights, by license or
otherwise, to any invention or any patent, copyright, trademark, or other intellectual
property right of Crowdstack. You shall not take any action to jeopardize, limit or
interfere with Crowdstack's ownership of and rights with respect to the products,
software and/or Crowdstack Marks. You acknowledge that any unauthorized copying or use
of the Crowdstack Marks is a Federal copyright violation.
Disputes and Venue
In the event that you have a dispute with a Participating Site, you release Crowdstack Strata and its
subsidiaries, affiliates, officers, agents, employees, partners, related entities, and licensors from any and
all claims of every kind arising out of such dispute. This Agreement shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict of law principles. Participants irrevocably consent to the nonexclusive jurisdiction and venue of the state and federal courts located in the State of Wyoming.
